Halbersbacher Hospitality Group GmbH (hhg) is the organiser of the events on offer. Upon purchase of a ticket, a contractual relationship regarding attendance at the event is established exclusively between the ticket holder (customer) and hhg. By ordering tickets, the customer instructs hhg to process the ticket purchase.
I. Scope
1. The following General Terms and Conditions apply exclusively in relation to hhg for all contracts and orders placed concerning the supply of tickets.
II. Conclusion of Contract, Cancellation
1. The offer to conclude a contract is made by the customer as soon as they click the so-called ‘Buy’ button or the button clearly labelled in accordance with Section 312j(3) of the German Civil Code (BGB). A contract between the customer and hhg is only concluded once hhg has allocated and sent the order and ticket numbers to the customer. Notwithstanding this, in the case of payment in advance, the contract is concluded upon successful debiting of the full payment amount from the customer’s payment account.
2. Unless otherwise agreed at the time of purchase, the commercial resale of the ticket(s) is not permitted; non-commercial resale is permitted only at a price equal to the printed price of the ticket(s), plus any proven fees or costs incurred at the time of the original purchase (e.g. postage and delivery charges), up to a maximum of 25 per cent of the printed price. In the event of a breach of the aforementioned condition, hhg shall be entitled to refuse admission to the event without compensation.
3. hhg is entitled to cancel an order placed by the customer for which an order and ticket number has already been allocated (unilateral right of withdrawal), if the customer breaches specific conditions set by hhg, which were highlighted during the advance booking process, or attempts to circumvent them (e.g. breaching restrictions on the number of tickets per customer, in particular prohibitions on resale, attempts to circumvent these by registering and using multiple user profiles, etc.) and/or if there are outstanding claims arising from the previous business relationship with the customer. In particular, without hhg’s prior written consent, neither the use of tickets for commercial advertising and/or marketing purposes (e.g. as prizes for commercial competitions and/or other commercial prize draws), nor is the resale of tickets permitted within the access and/or entrance areas of the event venue covered by hhg’s house rules. The declaration of cancellation or withdrawal may also be implied by crediting the amounts paid.
4. Sections 346 et seq. of the German Civil Code (BGB) apply to the aforementioned right of withdrawal, to the exclusion of Section 350 BGB.
5. In the event of events being rescheduled, hhg is entitled to declare the original tickets for the rescheduled event valid for the new, rescheduled date of the event. In such cases, it is not possible to return the tickets to hhg or to rescind the ticket purchase as a result of the rescheduling, unless it can be demonstrated that attending the rescheduled event is unreasonably onerous for the ticket holder. This does not apply if hhg is responsible for the rescheduling of the event.
III. Right of withdrawal and model withdrawal form
1. Consumers do not have a right of withdrawal, or the right of withdrawal may lapse prematurely in the case of the following contracts:
Contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, the carriage of goods, motor vehicle hire, the supply of food and drink, and the provision of other services relating to leisure activities, where the contract specifies a particular date or period for the provision of the service (Section 312g(2), first sentence, No. 9 of the German Civil Code (BGB)). This means that, insofar as hhg offers services relating to leisure activities, in particular tickets for events, there is no right of withdrawal. Any order for admission tickets is therefore binding immediately upon confirmation by hhg in accordance with Section II.1 and obliges the customer to accept and pay for the tickets ordered.
2. The following applies to all other contracts with consumers:
Cancellation Policy
Right of withdrawal
1. You have the right to withdraw from this contract within fourteen days without giving any reason.
2. The withdrawal period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the goods.
3. To exercise your right of withdrawal, you must inform us
Halbersbacher Hospitality Group GmbH
Mollistraße 10
18209 Bad Doberan
by means of a clear statement (e.g. a letter sent by post, a fax or an email) informing us of your decision to withdraw from this contract.
4. You may use the attached model withdrawal form (PDF) for this purpose, although this is not mandatory. You may complete the model withdrawal form and send it to us by email to info@halbersbacher.de. If you make use of this option, we will immediately send you (e.g. by email) confirmation of receipt of such a withdrawal.
5. To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this contract, we shall refund to you all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the cheapest standard delivery option offered by us), without undue delay and in any event within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will make this refund using the same payment method you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.
You can download the model withdrawal form as a PDF here.
IV. Retention of title; set-off; right of retention for purchase on account
1. In the case of a consumer, hhg retains title to the goods until the invoice amount has been paid in full. In the case of personalised tickets, the transfer of the claim arising from the ticket is subject to full payment of the invoice amount. The relevant security interests are transferable to third parties.
2. If the customer is a trader acting in the course of their commercial or self-employed professional activities, a legal person governed by public law or a special fund under public law, hhg reserves title to the goods purchased until all outstanding claims arising from the business relationship with the customer have been settled. In the case of personalised tickets, the transfer of the claim arising from the ticket is subject to the settlement of all outstanding claims arising from the business relationship with the customer. The corresponding security interests are transferable to third parties.
3. The customer shall only be entitled to set-off if their counter-claims have been legally established or are undisputed or acknowledged by hhg. Furthermore, the customer shall only have a right of retention if and to the extent that their counter-claim is based on the same contractual relationship.
4. If the customer is in default of any payment obligations to hhg, all outstanding claims shall become due immediately.
V. Limitations of Liability, Exclusion of the Right to Rescind in the Event of Certain Breaches of Duty
1. hhg shall in all cases bear unlimited liability under the Product Liability Act for damage caused intentionally or through gross negligence, in the event of fraudulent concealment of defects, and for damage resulting from injury to life, limb or health. Liability for damage arising from a breach of a guarantee is also unlimited.
2. In the event of a breach of essential contractual obligations (so-called cardinal obligations) resulting solely from simple negligence, hhg’s liability is limited to compensation for foreseeable damage typical of the contract.
3. Except in the cases referred to in paragraphs 1 and 2, hhg shall not be liable for damage caused by ordinary negligence.
4. The customer’s right to rescind the contract on the grounds of a breach of duty for which neither the organiser nor hhg is responsible, and which does not consist of a defect in the goods, is excluded.
5. Insofar as hhg’s liability is excluded or limited in accordance with the preceding paragraphs, this shall also apply to the liability of its vicarious agents and assistants.
VI. Final Provisions
1. The law of the Federal Republic of Germany shall apply exclusively. Notwithstanding the above provision on the choice of law, consumers whose habitual residence is outside the Federal Republic of Germany may always also invoke the law of the country in which they are domiciled.
2. The sole place of performance for delivery, services and payment shall be Bremen, provided that the customer is a trader within the meaning of Section 14 of the German Civil Code (BGB).
3. If the customer is a trader, the exclusive (including international) place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship shall be Rostock. In the case of cross-border contracts, this shall also apply to non-traders. hhg reserves the right to bring proceedings before any other court with international jurisdiction.
4. From 15 February 2016, the European Commission will provide an online dispute resolution platform here. hhg’s email address is info@halbersbacher.de.
5. hhg is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
